Rights
Your Rights, Wages and Conditions

In Australia there are minimum conditions of employment called the National Employment Standards (NES). Every employee must receive these minimum standards. Industry awards, enterprise agreements and common law contracts also form legally enforceable terms and conditions of employment over and above the NES minimums. It’s important you understand each of these and how they interact to create your individual terms of employment. We are available to explain what this means for your individual employment contract.

The following fact sheets provide an overview of what your rights and obligations at work are, and how the law protects your legal minimum terms and conditions.

These fact sheets are offered for information only and should not be considered as legal advice in any circumstances.

EBA
Enterprise Bargaining Agreement

Enterprise agreements are agreements made between employers and employees that contain terms and conditions of employment. They override the award and must be certified by the Fair Work Commission to be enforceable.
